Many companies do not undertake a rigorous assessment of their patent intellectual property position (PIPP). A company usually only reviews selected aspects of its PIPP. Such cursory review often only occurs in response to the company finding itself in a difficult situation such a cost savings initiative, inept due diligence assessment, misaligned patent portfolio, disadvantageous license/contract position, evidence of poor record keeping, freedom to operate impediment, or failure of confidentiality. However, a company could avoid these situations by implementing initiatives to assess one’s patent portfolio, patent procurement practices, license/contract negotiation practices, and statutory/administrative liabilities and developing strategies with regard thereto. Parker, III, Ph.D., Associate Vice-President & Head, Internal Medicine, Sanofi-Aventis US Inc. For over twenty years, Dr. Ray Parker has focused primarily on patent protection considerations in the pharmaceutical industry, including both firm and corporate experience at Pennie & Edmonds, J&J, Rhone-Poulenc Rorer, Eli Lilly & Company, Aventis Pharmaceuticals, and now sanofi-aventis. The practice has included drafting and prosecuting numerous patent applications, conducting FTO opinions, conducting licensing and due diligence assessments, counseling internal and external clients, managing adversarial actions, and managing and training other patent practitioners. He has also lectured extensively on an assortment of intellectual property issues. Dr. Parker earned his J.D. from New York University and his B.S. and Ph.D. in Chemistry from Rensselaer Polytechnic Institute.
