The Gujarat High Court today commuted to life imprisonment the death penalty awarded to four Pakistani nationals in a case related to waging war against the state and smuggling arms and ammunition in 1999. A Division Bench of Justices R P Dholakia and M D Shah reduced the sentence given in 2003 by a fast track court in Bhuj to Jamil Haji Jath, Osman Ali Mohammed Jath, Sachu Ibrahim Jath and Nawab Ali Jath - all residents of Kati Bandar locality of Sindh province. "We argued before the court that the four were Pakistani fishermen who had strayed into the Indian territory and the local police had falsely implicated them in the case," said Hashim Qureshi, the counsel for the convicts. "We also told the court that the sentence given to the four should be reduced to life in jail as this was not a rarest of rare case," he stated. The court also reduced their 20-year sentence to seven-year prison term for smuggling RDX and arms into the state, Qureshi added. The four were arrested in June 1999 from Harami Nala area near Bhuj town of Kutch district of Gujarat bordering Pakistan.
