Permission sought to sue Raj Thackeray for contempt of court

Two city-based organisations have sought permission from the state Advocate General to file a case against Maharashtra Navnirman Sena president Raj Thackeray for contempt of court over his statement that no lawyer should defend the July 11 Mumbai serial blasts accused.

Thackeray had said in a rally on July 16 that no lawyer should defend the accused in the serial blasts case and MNS would not let any lawyer accepting blast accused's brief "move around" on Mumbai streets.

Taking exception to these statements, Suresh Rajeshwar of 'Indian Association of People's Lawyers' and Monica Sakhrani of 'Commitee for the Protection of Democratic Rights' have written a letter to Advocate General Ravi Kadam for his consent for filing criminal contempt case against Raj in High Court.

Advocate General's permission is necessary if a private citizen wants to initiate action under Contempt of Court Act.

The applicants, in the letter to Kadam, have written that as a result of MNS chief's threat, the accused in serial blast case might not get lawyers, and they would be deprived of fair trial, which is a constitutional right.

The applicants have further stated in the letter that Thackeray's statement "interfere with the administraion of justice and tend to lower authority of the court in the eyes of the public." Therefore, the MNS chief's statements amount to contempt of court, the letter said.
